The Arbitration Proceedings with Amazon in Singapore “Illegal”

Future Retail had filed a petition in an arbitral tribunal in Singapore, arguing that it would be illegal to continue the proceedings against Amazon in view of the CCI’s decision.

Future Retail has asked the Delhi High Court to declare illegal the arbitration proceedings with e-commerce company Amazon in Singapore. The Kishor Biyani-owned company said that India’s competing agency has canceled the 2019 deal with Amazon. Earlier, the Competition Commission of India (CCI) had banned the deal with Future Group, giving a big blow to the giant American company Amazon. Along with this, a fine of 200 crores was also imposed on him. The commission had said that while taking permission from the regulator, some important information was hidden from Amazon. The next hearing will be on next Monday.

At the same time, the court has decided to hear the petition of Future Group. Senior advocate Mukul Rohatgi argued before a division bench of Chief Justice DN Patel and Justice Jyoti Singh that he had filed a petition on behalf of Future Coupons Limited (FCPL) and the matter is of utmost urgency. He said that the registry has approved the petition.

The bench has decided to hear the petition along with another matter dealing with the same dispute. The controversy comes after the Competition Commission of India (CCI) recently suspended the approval given to Amazon’s 2019 deal with Future. The commission had imposed a fine of Rs 202 crore on the US e-commerce giant for allegedly suppressing facts and making false statements while seeking regulatory approval.

Last month, Amazon had moved the Delhi High Court challenging the probe initiated by the Enforcement Directorate (ED) into the deal.
