Justice of Japan Files New İndictment Against Carlos Ghosn

Brazilian executive has been provisionally arrested since April 4 and term ends on Monday (22). Lawyers filed for bail.

Japanese prosecutors on Monday presented a new complaint against the Brazilian executive Carlos Ghosn, former president of the automakers Nissan and Renault. The prosecution, the fourth against the businessman since November last year, is about mismanagement of funds through a company based in Oman.

The businessman has been incarcerated since last April 4 and the term of this provisional arrest ends on Monday, but with this new complaint the Brazilian can remain in custody.

Accused of financial misconduct, the Brazilian was arrested for the second time at his home in Tokyo earlier this month. It had been less than a month since he had been awaiting his free trial, under a series of restrictions, after paying a million-dollar bail.

The executive’s first term in prison lasted 108 days and began last November when the scandal surfaced. The Brazilian, then considered a “superstar” in the automotive sector and commander of the Renault-Nissan-Mitsubishi alliance, has been accused of financial breaches,  of trust and passing on personal debt to Nissan.

Carlos Ghosn arrested: what is known so far

Prosecutors also said that Ghosn gave $ 5 million in damages to Nissan over a 2 1/2 year period, which lasted until July 2018, violating its legal obligations to the company and aiming for personal gain.

According to the Kyodo news agency, the damage involves transferring funds through the subsidiary to the account of an Oman dealership that in practice belongs to Ghosn, called Suhail Bahwan Automobiles (SBA).

Ghosn denies wrongdoing and says he was the victim of a plot by the Nissan directors who did not agree with his intention to merge with Renault.

His defense released a video recorded before the second arrest, in which he reaffirms to be innocent. Ghosn’s wife, Carole, has sought help from France and the United States to have a “balanced judgment” and criticized the Japanese authorities’ treatment of the Brazilian.
