Court Decision Made About Osman Kavala

Istanbul 13th High Criminal Court decided to continue the detention of Osman Kavala.
The Committee of Ministers of the Council of Europe initiated a “violation procedure” for Turkey, which did not comply with the decision of the European Convention on Human Rights to release Osman Kavala.S
After being detained in Gaziantep on 17 October 2017, Osman Kavala was arrested on 1 November on charges of attempting to overthrow the government or prevent him from doing it duty and attempting to overthrow the constitutional order by using force and violence, and was sent to Silivri Prison. He has been in prison for 1515 days since then.
The Gezi trial indictment, which includes Kavala, who took part in the Gezi protests, made phone calls with members of Taksim Solidarity and allegedly was the financier of the protests, was drafted 16 months after his arrest and was accepted by the Istanbul 30th High Criminal Court.
On 10 December 2019, the ECHR ruled that Kavala’s detention should not continue and that his detention was a violation of his rights.
KAVALA REJECTS THE CHARGE OF INSPECTION
In the sixth hearing of the trial, which started on June 24, 2019, Kavala and all the other defendants were acquitted. However, Osman Kavala was arrested again, before he was released from prison, on the charges that he was acquitted on the basis of Article 309 of the Turkish Penal Code (TCK), that is, on 11 October 2019.
Osman Kavala, along with 16 people from the US academic Henri Barkey and Taksim Solidarity, and 35 names from Çarşı, one of the supporters of Beşiktaş club, in his last case before the Istanbul 13th High Criminal Court, on charges of ‘attempting to overthrow the government’. is on trial.
Osman Kavala, who was accused of ‘espionage’ within the scope of this case, denied these allegations at the hearings.
VIOLATION PROCEDURE STARTED ABOUT TURKEY
The Committee of Ministers of the Council of Europe, requesting the implementation of the previous decision of the European Court of Human Rights on Kavala, initiated a “violation procedure” against Turkey at its meetings between 30 November and 2 December.
Osman Kavala, who announced that he would not attend the proceedings due to the statements made by President Erdoğan about himself, did not attend the second hearing. The third hearing of the case will be held on January 17.
