Osman Kavala Decision from the Council of Europe

The Committee of Ministers of the Council of Europe, by majority vote, decided to refer Osman Kavala to the ECtHR.

The Committee of Ministers of the Council of Europe took a critical decision about Osman Kavala. The European Court of Human Rights (ECHR) made a new vote to initiate a “violation procedure” against the Kavala decision.

The interim decision was accepted by a majority of votes. The infringement procedure against Turkey was officially started. This procedure went down in history as the first violation procedure against Turkey and the second in the history of the Council of Europe.

The Committee of Ministers of the Council of Europe made a statement on December 2, 2021, containing its intention to refer the issue of whether Turkey has implemented the Kavala decision of the European Court of Human Rights (ECHR) to the ECtHR, and requested us to convey our opinion on the subject.
